Terms of Service

Welcome to StitchDaddy. These Terms of Service ("Terms") govern your use of the StitchDaddy website and services (the "Service"), operated by StitchDaddy ("StitchDaddy," "we," "us," or "our"), based in Ontario, Canada.

By creating an account, uploading artwork, or placing an order, you agree to these Terms. If you do not agree, please do not use the Service.

1. What We Provide

StitchDaddy provides embroidery digitizing: conversion of your artwork into embroidery machine files, performed by skilled human digitizers.

You upload artwork, tell us the placement, finished size, and file formats you need, and receive digital machine files. We do not produce physical goods through this Service.

Discontinued services. We previously also offered an automated vector (SVG) conversion service, on its own or combined with digitizing. That service is no longer available to order. If you purchased vector files before it was discontinued, those files remain available in your dashboard and the terms you agreed to at the time continue to apply to them.

2. Accounts

You need an account to place orders and receive files. You are responsible for keeping your account credentials secure and for all activity under your account. You must provide accurate information and be at least the age of majority in your province or territory.

3. Payment

  • All services are paid for in advance, at the prices shown at checkout.
  • Payments are processed by our payment processor, Stripe. We do not store your full card details.
  • Digitizing orders are delivered within the turnaround time stated at checkout (for example, standard or rush). The turnaround clock starts at payment and runs continuously, pausing on weekends (Saturday and Sunday, US Eastern) when we are closed. Turnaround times are estimates. Complex artwork may require additional time, in which case we will notify you of a revised delivery estimate. Rush orders are prioritized but complex artwork may still require additional time beyond the standard rush target.

4. Refunds

  • Digitizing orders: if you are not satisfied with your digitized file, we offer free revisions until it is right, rather than refunds. Please contact us with details of the issue and we will work to correct it.
  • If we cannot complete your order, or you decline a custom quote for complex artwork, we refund what you paid for it.
  • We may, at our sole discretion, issue a refund in other circumstances, but you should not rely on refunds being available for delivered digital files.

5. Your Artwork and Intellectual Property

  • You must own or have the rights to any artwork you upload. By uploading artwork, you confirm that you have the legal right to use it and to have it digitized, and that doing so does not infringe any third party's intellectual property, trademark, or other rights.
  • You are solely responsible for the content you upload. We are not responsible for verifying ownership, and we may refuse or remove any order that we believe infringes the rights of others or violates these Terms.
  • You retain ownership of your original artwork. Once we deliver your files and your order is paid, you own the delivered embroidery files for your use.
  • You grant us a limited license to use, process, and store your artwork solely to provide the Service to you (including sharing it with our digitizers to complete your order).

6. Acceptable Use

You agree not to use the Service to upload or request work on any content that is illegal, infringing, hateful, or otherwise violates the rights of others. We may suspend or terminate accounts that violate these Terms.

7. Delivered Files and Machine Compatibility

  • Embroidery machine files are produced with care by skilled digitizers. However, embroidery equipment, hooping, stabilizers, threads, and fabrics vary widely.
  • We do not guarantee that a delivered file will run flawlessly on your specific machine or setup. Some adjustment may be required on your end.
  • Digitizing is a craft performed by humans; results reflect professional judgment and may not exactly match any preview or mockup.
  • If a file has a genuine quality issue, contact us and we will revise it (see Refunds).

8. Limitation of Liability

To the fullest extent permitted by law, StitchDaddy is not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including lost materials, lost production time, or costs arising from files that require adjustment on your equipment. Our total liability for any claim relating to an order will not exceed the amount you paid for that order.

9. Services We Rely On

The Service relies on outside providers (for example, for payments, file processing, authentication, email, storage, and hosting). Your use of the Service is also subject to those providers' terms where applicable. We are not responsible for the acts or omissions of those providers.

10. Changes to the Service and Terms

We may update the Service or these Terms from time to time. Material changes will be posted here with an updated date. Continued use of the Service after changes means you accept the updated Terms.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms.

12. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to its rules on conflict of laws.
